This Privacy Policy explains how Underground, Inc. (“Underground, Inc.,” “UGI,” “we,” “our,” or “us”) collects, uses, and protects information you provide when you visit undergroundincutilities.com (the “Site”), request a quote, apply for a role, or otherwise contact us — including any information you provide in connection with SMS/text messages.

1. Who we are

2. Information we collect

When you use the Site or contact us, we may collect:

• Contact details you provide — name, phone number, email address, and mailing address or job location.
• Project or employment details you provide — scope of work, job description, years of experience, prior employers, and similar information.
• SMS/text consent records — the fact that you opted in to receive text messages from Underground, Inc., the phone number you provided, the date and time of consent, and the disclosure text shown at the time of consent.
• Technical information automatically collected when you visit the Site — IP address, browser type, device information, referring page, pages viewed, and similar log data. The Site does not currently use analytics or advertising cookies.

3. How we use information

We use the information above to:

• Respond to quote requests, questions, and employment inquiries.
• Send SMS/text messages you have opted in to receive, such as project updates, appointment or schedule confirmations, quote follow-ups, employment follow-ups, and, if you separately consent, occasional promotional messages from Underground, Inc.
• Operate, secure, and improve the Site.
• Comply with legal, tax, insurance, and regulatory obligations.

4. SMS/text messaging — consent and non-sharing

Text messaging originator opt-in data and consent will not be shared with any third parties. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

If you provide a phone number and check an SMS opt-in box on our forms, or you text us directly, you consent to receive text messages from Underground, Inc. at the number you provided. Message content may include quote follow-ups, project or schedule updates, employment follow-ups, and, if you consented to promotional messages, occasional offers or announcements from Underground, Inc.

Consent to receive text messages is not a condition of any purchase, quote, or employment consideration. You can request a quote or apply for a role without opting in to text messages.

5. How we share information

We do not sell your personal information. We share information only in these limited situations:

• Service providers that help us run the business — such as our email host, SMS platform (DailyReach.io), IT and hosting providers (including Cloudflare) — under confidentiality obligations and only to the extent needed to provide their services to us.
• Legal and safety reasons — when required by law, court order, or to protect the rights, property, or safety of Underground, Inc., our employees, or the public.
• Business transfers — in connection with a merger, acquisition, financing, or sale of assets, subject to standard confidentiality terms.

As stated in Section 4, SMS opt-in data and consent are never shared with any third parties, and mobile information is never shared with third parties or affiliates for marketing or promotional purposes.

6. How long we keep information

We keep quote-request, employment-inquiry, and general contact information for as long as needed to respond to your request and for a reasonable business, tax, insurance, and legal-records period after that — typically up to seven years. SMS opt-in and consent records (phone number, date/time of consent, and disclosure text shown) are retained for the duration of your subscription and for at least four years after you opt out, to demonstrate compliance with applicable telemarketing and messaging laws. You can ask us to delete your information sooner where we are not required to keep it — see Section 8.

7. How we protect information

The Site is served over HTTPS. We use reasonable administrative, technical, and physical safeguards to protect the information we collect. No method of transmission or storage is 100% secure, so we cannot guarantee absolute security.

8. Your choices and rights

• Opt out of SMS at any time by replying STOP to any text message from Underground, Inc., or by contacting us at the phone or email below.
• Access, correct, or delete the information we hold about you by contacting [email protected]. We will respond within a reasonable time, subject to any records we are legally required to keep.
• State-law rights. If you are a resident of a state with a comprehensive privacy law that applies to Underground, Inc., you may have additional rights (such as to know, correct, delete, or opt out of the sale or sharing of personal information). Contact [email protected] to exercise them. We do not sell personal information and we do not share mobile information for cross-context behavioral advertising.

9. Children

The Site and our services are directed to businesses and adult customers. We do not knowingly collect personal information from children under 13. If you believe a child has provided information, contact [email protected] and we will delete it.

10. Third-party links

The Site may link to third-party sites (for example, our Facebook page or Google Maps). Those sites have their own privacy practices and this Policy does not apply to them.

11. Changes to this Policy

We may update this Policy from time to time. When we do, we will update the “Last updated” date above and, when appropriate, provide additional notice on the Site.
