These Terms of Service (“Terms”) govern your use of undergroundincutilities.com (the “Site”) and any SMS/text messaging you receive from Underground, Inc. By using the Site or by opting in to receive text messages from us, you agree to these Terms.
1. About Underground, Inc.

2. Use of the Site
You may use the Site to learn about our services, request a quote, or apply for a role. You agree not to misuse the Site — for example, by attempting to interfere with its operation, submitting false information, or using it to violate any law. We may change, suspend, or discontinue any part of the Site at any time without notice.
3. SMS / text messaging program
Underground, Inc. offers an SMS/text messaging program for customers, prospects, applicants, and other people who have provided their mobile number and opted in to receive text messages from us.
3.1 Program description
If you opt in, Underground, Inc. may send you text messages related to your interaction with us, including:
- Quote follow-ups and clarifying questions about a job.
- Project, schedule, and appointment updates.
- Employment follow-ups if you have applied for a role.
- If you have also consented to receive promotional messages, occasional offers or announcements from Underground, Inc.
3.2 Message frequency
Message frequency varies.
3.3 Cost
Message and data rates may apply. Check with your mobile carrier.
3.4 Opt-out
You can cancel the SMS service at any time. Reply STOP to unsubscribe. After you send the STOP message, we will send you a message confirming that you have been unsubscribed. After that, you will no longer receive text messages from Underground, Inc. If you want to join again, sign up as you did the first time and we will start sending messages again.

3.6 Supported carriers
The SMS program is available on major U.S. carriers including AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, Virgin Mobile, and Cricket Wireless, and may work on other carriers. Carriers are not liable for delayed or undelivered messages.
3.7 Not a condition of purchase
Consent to receive text messages is not a condition of purchasing any goods or services from Underground, Inc. or of being considered for employment.
4. Privacy
Your use of the Site and the SMS program is also governed by our Privacy Policy, which explains how we collect, use, and protect information — including the required disclosure that text messaging originator opt-in data and consent will not be shared with any third parties, and no mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
5. Quotes and estimates
Quotes submitted through the Site are requests for information, not binding offers. Any pricing, schedule, scope of work, or estimate we provide is subject to a written agreement between Underground, Inc. and the customer and to site conditions, permits, utility locates, and other factors identified during scope development.
6. Employment inquiries
Submitting the employment interest form or otherwise expressing interest in a role does not create an offer or guarantee of employment. 7. Intellectual property
The Site, including its text, logos, images, and design, is owned by Underground, Inc. or its licensors and is protected by intellectual property laws. You may view and print pages of the Site for your personal or internal business use. You may not copy, modify, distribute, sell, or lease any part of the Site without our prior written consent, except as expressly permitted.
8. Disclaimers
The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Underground, Inc. disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Descriptions of services on the Site are general and do not constitute a professional recommendation for any specific project.
9. Limitation of liability
To the maximum extent permitted by law, Underground, Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or lost data, arising out of or related to your use of the Site or the SMS program. Our total aggregate liability for any claim arising out of or relating to the Site or the SMS program will not exceed one hundred U.S. dollars ($100).
10. Indemnification
You agree to defend, indemnify, and hold Underground, Inc. harmless from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your use of the Site in violation of these Terms or applicable law.
11. Governing law
These Terms are governed by the laws of the State of Alabama, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved in the state or federal courts located in Mobile County, Alabama, and you consent to the personal jurisdiction of those courts.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of the Site or the SMS program after an update constitutes acceptance of the revised Terms.
